Tenants’ Right to Manage

Although acquiring the freehold will usually be the preferred option for groups of tenants, there will be many occasions when this is for some reason not appropriate, for example if the monies cannot be raised to buy the freehold or if the leases are long and the property market is falling.

In those situations the right to manage provides a valuable tool for groups of tenants who wish to control the way in which their block of flats is run. It is a no-fault right which means that the tenants are not required to prove any complaint against the Landlord or his managing agents. This right was only brought into force in October 2003 but already we have successfully obtained the right to manage for a number of blocks ranging in size from 40 flats down to two or three. We have specific experience in more complicated matters such as dealing with estates with multiple blocks of flats.
