Right to Manage
The right to manage refers to the statutory right for flat owners to come together to take over the management of their building.
It is an economical alternative to buying the freehold and provides an opportunity for flat owners to appoint directly accountable managing agents, to set the agenda for the upkeep of the building and inevitably to make often substantial savings on items such as building insurance and administrative charges.
The right to acquire the management of a building is not dependent on the landlord having acted negligently, or the building being poorly maintained.
However, the procedure is highly technical. Disgruntled landlords are prone to exploiting minor irregularities to dispute right to manage claims, but the solicitors in our commercial team have proven themselves more than a match for even the most vexatious landlords.
A successful right to manage claim is an excellent platform from which to launch a claim for the ownership of the freehold.
